PAIA MANUAL
The manual contemplated in section 51 of the Promotion of Access to Information Act 2 of 2000, describing the Association's records and how to request access to them.

1. Introduction
This is the manual contemplated in section 51 of the Promotion of Access to Information Act 2 of 2000 ("PAIA"), read with the Protection of Personal Information Act 4 of 2013 ("POPIA"), for the Association for Black Business Rescue and Insolvency Practitioners of South Africa ("ABRIPSA", "the Association"). It describes the records the Association holds and the procedure by which a requester may seek access to those records. It has been prepared in working-draft form and will be placed before the National Executive Committee for formal adoption.

- Information Officer — Under section 1 of POPIA read with section 51 of PAIA, the head of a private body is its highest-ranking office-bearer; the Information Officer role therefore vests ex officio in the Chairperson of the Association, Mr Enver Motala, until the National Executive Committee designates and registers a specific Information Officer.
3. The section 10 Guide
The Information Regulator has, in terms of section 10 of PAIA, published a Guide on how to use the Act. The Guide explains how to exercise the rights conferred by PAIA and POPIA and is available in all official languages. 4. Records available in terms of other legislation
The Association keeps records in terms of, among others, the following legislation, and access to those records is given in accordance with that legislation read with PAIA:
- Companies Act 71 of 2008 — the Memorandum of Incorporation and the registers and records a non-profit company is required to keep under that Act.
- POPIA — records relating to the processing of personal information, including this manual and the Association's privacy notice.
- Tax Administration Act 28 of 2011 — tax and related records retained as required by tax legislation.
5. Categories of records held
The Association holds records in the following categories:
- Governance — the constitution, the Memorandum of Incorporation, minutes of the National Executive Committee and of its committees, policies and the code of conduct.
- Membership — membership applications, the membership register, membership certificates and CPD records.
- Financial — subscription records, invoices, banking records and financial statements.
- Correspondence — correspondence with members, regulators and third parties.
- Website and communications — published news items, event information and notices.
The constitution, the code of conduct and policies (once adopted by the National Executive Committee), news items and event information are automatically available on this website and may be inspected without a PAIA request. All other categories are available on request in accordance with the procedure in section 6 of this manual, subject to the grounds for refusal in PAIA.
6. How to request access to records
A request for access is made on Form 02 (Request for Access to Record) prescribed under the PAIA Regulations, 2021, obtainable from the Information Regulator's website. The completed form is submitted to the Information Officer at info@abripsa.org.za or by post to Office No. 3, 12th Avenue, Houghton Estate, Johannesburg, 2198. The request must identify the record and the form of access required and, where the requester relies on a right other than a right of access to personal information about themselves, identify the right the requester seeks to exercise or protect and explain why the record is required for that purpose.
The prescribed fees in Annexure A of the PAIA Regulations apply. A requester other than a personal requester pays a request fee of R140; reproduction, search and preparation fees, and any deposit, are charged at the Annexure A rates in force at the time of the request. A personal requester — a person requesting access to a record containing personal information about that person — does not pay the request fee but may be charged the prescribed reproduction fees. The Association must decide on a request within 30 days of receipt, which period may be extended in the circumstances PAIA permits.
7. Grounds for refusal and remedies
Access to a record may or must be refused on the grounds set out in PAIA, including the protection of the privacy of third parties who are natural persons, the protection of commercial and confidential information of third parties and of the Association, records privileged from production in legal proceedings, and, to the extent the Act permits, certain records of the Association's own internal deliberations. Where a request concerns a record relating to a third party, the third-party notification and intervention procedures in PAIA are followed before a decision is made.
A requester aggrieved by a decision may raise the matter with the Information Officer for reconsideration, lodge a complaint with the Information Regulator at PAIAComplaints@inforegulator.org.za, or apply to a court with jurisdiction.
8. Processing of personal information (POPIA)
The Association processes personal information as described in its privacy notice, which sets out the purposes of processing, the categories of personal information and of data subjects concerned, the recipients of personal information, the security safeguards applied and the rights of data subjects. The privacy notice is available at /privacy.html and should be read with this manual.
9. Availability of this manual
This manual is available on this website at /paia.html and for inspection at the registered office on request during business hours. It will be updated whenever there is a material change to the information it contains.
