BRP LICENCE ROADMAP

The road to a CIPC business rescue practitioner licence, phase by phase. Section 138 of the Companies Act 71 of 2008 requires good standing in a legal, accounting or business management profession together with a licence issued by the CIPC.

Phase 1 — Qualification
NQF level 7 qualification in law, accounting or business management obtained, with certified copies of the certificates to hand.
Membership of a legal, accounting or business management professional body (for example LPC, SAICA, SAIPA or equivalent) confirmed and in good standing.
Certificate of good standing or proof of membership obtained from the professional body.
Phase 2 — Experience record
Experience record compiled: engagements, roles held, sectors and outcomes relevant to turnaround, restructuring and insolvency work.
CV updated to reflect restructuring and insolvency experience, matching the experience record.
Confirmations or referees for key engagements identified where available.
Phase 3 — CoR 126.1 application
Form CoR 126.1 — the application for a business rescue practitioner licence — completed.
Supporting documents prepared: certified copy of ID or passport, certified copies of qualifications, CV and professional certificates.
CIPC e-services profile registered and customer code active.
Application submitted through CIPC e-services and proof of filing retained.
Phase 4 — Licence category and after
Expected licence category considered — licences reflect the practitioner's experience, and conditional licences are available for newer practitioners.
Any conditions attached to the licence noted and diarised.
Annual renewal requirements diarised.
CPD and professional conduct obligations planned, including the Association's CPD programme and good standing with your primary professional body.
